Community Supervision for Life and Parole Supervision for Life conditions and provisions can be taxing on the convicted sex offender who wishes to rehabilitate and move on with his or her life. However, the State of New Jersey continues to increase the required provisions and conditions for registrants of PSL and CSL. In August 2007, Governor John Corzine signed the Sex Offender Monitoring Act which requires certain high-risk offenders to wear GPS tracking units 24-7.
A registrant will be subjected to the Sex Offender Monitoring Act if he or she has been accessed to be a high-risk offender, and:
- Subjected to civil commitment as a "sexually violent predator" and has been conditional discharged;
- Sentenced to a term of CSL or PSL; or
- Has been convicted or adjudicated delinquent for a sex crime against a person under the age of 18 or over the age of 60.
The GPS device will be used to continuously track the geographic location of the offender, and the information will be shared with law enforcement agencies to determine whether any reported criminal activity correlate with the offender's location at the time of the incident. Any person who tampers with the device will be guilty of a third degree crime, which is punishable by 3 to 5 years in prison.
In September 2011, the Sex Offender's Monitoring Act was deemed unconstitutional when applied retroactively. In Riley v. New Jersey State Parole Board, the court ruled that the Act cannot apply to anyone who was convicted prior to the enactment of the law in 2007. The New Jersey and United State Constitution prohibits the application of ex post facto laws. As a result, the mandated submission to the Sex Offender Monitoring Act is unconstitutional if the offender was convicted prior to August 2007.
