When a person is arrested on demand for extradition in New Jersey, he or she is afforded certain rights. First, the accused is given a hearing before the New Jersey Superior Court in the arresting county where a judge will inform the accused of the following:
1. A state, outside of New Jersey, has demanded his surrender
2. The criminal charges against him
3. The right to acquire a lawyer
Last, the accused is asked if he or his lawyer wishes to challenge the legality of the extradition. If the accused wishes to contest the extradition, he may apply for a writ of habeas corpus, which is formal order requesting an investigation by the court. The judge will then schedule a hearing to review the matter.
